Agreement

These Terms of Service (“Terms”) govern your use of the Grainroom iPhone application, website, and related services (together, “Grainroom”). By downloading, accessing, or using Grainroom, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Grainroom.

You must be at least 13 years old to use Grainroom. If you are not old enough to enter into a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you.

Your license to use Grainroom

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Grainroom on Apple-branded devices you own or control, as permitted by the App Store Usage Rules, for personal and lawful purposes.

You may not copy, rent, sell, distribute, sublicense, reverse engineer, bypass security or usage limits, interfere with operation, introduce malicious code, or use Grainroom to violate another person's rights or applicable law, except where a restriction is prohibited by law.

Your photographs

You retain your rights in photographs and other content you create with Grainroom. Grainroom processes photographs on your device and does not upload them to us. You are responsible for your content, for having permission to photograph and share it, and for keeping backups you want to preserve.

Grainroom's looks and effects may change an image's color, framing, resolution, metadata, or other characteristics. Preview and final output may vary by device, lighting, iOS version, and settings.

Our intellectual property

Grainroom—including its software, interface, camera designs, artwork, effects, text, trademarks, and branding—is owned by us or our licensors and protected by intellectual-property laws. These Terms do not transfer ownership to you or grant permission to use Grainroom branding outside ordinary use of the app. Feedback you voluntarily provide may be used without restriction or compensation to improve Grainroom.

Availability and changes

We may add, change, suspend, or discontinue features, compatibility, or Grainroom itself. Updates may be required for continued use. We do not promise that Grainroom will always be available, error-free, or compatible with every device or iOS release.

We may suspend or terminate access if you materially violate these Terms or if necessary to protect Grainroom, its users, or others. You may stop using Grainroom at any time by deleting the app.

Apple and third-party services

Your use of Grainroom is also subject to applicable Apple Media Services Terms and App Store Usage Rules. These Terms are between you and Grainroom, not Apple. Apple is not responsible for Grainroom, maintenance, support, or claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.

Grainroom uses third-party software and services, including PostHog for limited analytics and error reporting. Their availability and operation may be outside our control. Our handling of analytics is described in the Privacy Policy.

Disclaimers

To the fullest extent permitted by law, Grainroom is provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or data preservation. We do not warrant that every photograph will capture, process, save, export, or remain recoverable. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Grainroom and its operator, contributors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost photographs, data, profits, goodwill, or opportunities arising from your use of or inability to use Grainroom. This limitation does not apply where liability cannot legally be limited.

Governing law

These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws principles. This provision does not deprive you of any mandatory consumer protections that apply under the laws where you live.

General terms

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, or transfer of Grainroom. These Terms and the Privacy Policy are the entire agreement about Grainroom.

We may update these Terms by posting a revised version and changing the effective date. Continued use after an update takes effect means you accept the revised Terms. For questions, email contact@grainroom.app.
